The biggest problem a landlord faces when the tenant turns out to be a bad one. The tenant defaults in the payment of the rent and/or do not live in orderly fashion. Naturally, a landlord would like to evict such a bad tenant from his/her property in such a case.
For a landlord, there are three grounds when he or she could Evict Tenant legally.
Nonpayment of Rent
This is the most common reason for which a landlord would like to evict any tenant. A lease or rental agreement would clearly state the date when the payment of the rent for the property which has been lent out becomes due. There are might be some more time given as a grace period. Therefore, if the rent becomes due on the first day of each month and ten days are given as grace period then the rent would be due for payment on the eleventh. If the tenant pays his dues within this period, the landlord cannot take any legal action to evict the tenant. Only, when the tenant fails to pay within this period, the landlord could initiate any legal action to realize the due amount.
Lapse of Time
Lapse of Time eviction occurs when the landlord evicts a tenant because the lease or rental agreement with the tenant has expired. A lapse-of-time eviction can be done when a lease is in its final month, and is the type of eviction procedure commonly used by landlords who give month-to-month tenancies. To carry out such eviction, the landlord has to state he or she wants to take the possession of the property. No other condition requires to be fulfilled for carrying out this kind of eviction.
Nuisance
Landlords have a right to evict tenants if the tenant has become a nuisance to the property as long as the agreement includes a nuisance clause. A nuisance could be someone who throws loud parties every night or who continuously disturbs the neighbors, resulting in police visits to the property. In this case, tenants have a right to use and occupy a rental unit in any way they want as long as it does not infringe on the quiet enjoyment of other tenants in the building or violate federal, state, and local laws.
A landlord should be quite familiar with all the legalities involved for renting the property. He or she should clearly understand what are the responsibilities of a landlord and the conditions under which a tenant could be legally evicted.
